The Burlingame man accused of beating and strangling his girlfriend before trying to kill himself will not stand trial for attempted murder.
During a hearing Friday, Judge James Ellis granted a motion filed by the attorneys of 24-year-old Clovis Alberto Furtado Menezes to dismiss the attempted murder charges.
Menezes is still being charged with four counts of assault with a deadly weapon, spousal abuse and criminal threats.
Menezes was arrested Feb. 17 after the U.S. Coast Guard found him about 500 feet down a Devil's Slide cliff. A suicide note by Menezes was found in his car, which was left on the edge of Highway 1. Earlier that morning, Burlingame police responded to a domestic violence call. They found Menezes' unidentified girlfriend of three years had been severely choked and beaten about her face and neck before the woman's roommate was able to get Menezes off her, according to police reports.
The attack was reportedly prompted by the woman refusal to have sex with him. Police reported the assault was not the first against the woman. The couple has a 1-year-old son.
