1. Agreement to Terms By accessing or using smdailyjournal.com (the "Service"), provided by SMDJ, LLC ("Company," "we," "us"), you agree to be bound by these Terms of Use. If you do not agree, do not use the Service.

3. User Accounts & Commenting To access certain features, you may be required to create an account. You are responsible for maintaining the confidentiality of your credentials.

• Community Standards: We do not endorse and are not responsible for comments or opinions posted by users. We reserve the right, but have no obligation, to monitor, edit, or remove content that we deem offensive, unlawful, or in violation of these Terms.

• Public Record: As noted in our Privacy Policy, information submitted for publication in Legal Notices (FBNs, etc.) is intended for the public record and cannot be removed.

4. Intellectual Property All content on the Service, including text, graphics, and logos, is the property of SMDJ, LLC or its content suppliers and is protected by U.S. and international copyright laws. You may not reproduce or distribute content without express written permission.

5. Disclaimers & Limitation of Liability THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. SMDJ, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

6. Dispute Resolution (Arbitration & Class Action Waiver) Any dispute arising from these Terms shall be resolved through binding arbitration in San Mateo County, California. YOU AGREE TO WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

7. Governing Law These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
