The Jan. 28 Daily Journal article “Charges dismissed against former deputy” reported “Lopez allegedly listed his residence as being in Redwood City but was allegedly living in Newark when he filed to run for sheriff in 2014.” District Attorney Wagstaffe should read California Elections Code which says we can have more than one residence, even though we can vote in only one residence. The jurisdiction where we vote and can stand for election is called our “domicile.”
Further, it says if we take another residence where our family does not live with us, this new residence is our domicile. Deputy Lopez bought a new residence in Redwood City and registered to vote in San Mateo County over a year before the election and his family remained in his Newark residence. So, he was certainly a legal candidate for sheriff. If District Attorney Wagstaffe doesn’t read or understand the election code, he is not fit to be district attorney. If Wagstaffe accused Deputy Lopez in retribution for running for election to replace Sheriff Munks, then he ought to be in prison.
