Could a president deploy wartime law against the Beatles? Trump administration says “Yes”
The Trump administration is arguing the government could detain and deport British people under an 18th century wartime act if a president found there was a “British invasion” corrupting young Americans. An administration lawyer made that argument Thursday in response to a judge's “fanciful” question during an appellate hearing over its use of the Alien Enemies Act against a Venezuelan gang. The administration was arguing that courts cannot second-guess President Donald Trump's determination that the gang had invaded the country. One judge asked if a court could second-guess an administration panic over the Beatles' so-called British invasion in the 1960s. The administration lawyer said the check on presidential powers there would come from Congress and voters, not judges.
