Nazareth Ice Oasis has already closed its second-floor grill because a the suit, which was filed in part because the grill is not accessible to disabled people.
Nazareth Ice Oasis in Redwood City will remain open after the business faced an Americans with Disabilities Act lawsuit that threatened its future, a representative of the company said Friday.
The lawsuit was filed against the rink in January and the plaintiff and Nazareth have since reached a settlement, the representative said.
“We’re relieved,” he said. “It’s unfortunate the way some of this has panned out, but fortunately we’re able to come to a reasonable settlement and keep the rink open so all parties are happy, albeit our pocketbooks are not so happy.”
Sarah Feldman, CEO and founder of the Silicon Valley Ice Skating Association, which has advocated for additional skating space in the area, said the Peninsula’s ice skating community will also be relieved.
“This is phenomenal news. I’m glad that they’ve found a way to keep it open,” she said. “I know there was a lot of worry and I’m excited for the community.”
She added that the county is still in need of additional ice rinks to meet demand.
“There’s probably a need for six rinks across the county,” she said.
Nazareth Ice Oasis, located at 3140 Bay Road, was sued because its second-floor grill is not accessible to people with disabilities, according to the lawsuit.

The lawsuit originated when plaintiff Marva Samuel, represented by Oakland-based Rein and Clefton, visited the ice rink with her family in November. Samuel, who was using a walker at the time because she suffers from osteoarthritis and degenerative disc disease, asked an employee if there was an elevator she could use to access the grill. That employee allegedly told her stairs were the only option, treated her disrespectfully and did not offer to bring her food, according to the suit.
Nazareth closed the grill after the lawsuit was filed and the company’s representative isn’t sure if or when the grill might reopen.
If the grill does reopen, then a clearly designated eating area with tables will be set up on the ground level, the representative said.
He also said the company will not be installing a “cost prohibitive” elevator, but it will close the rink for a few months over the summer to make various improvements to the space, including a new sheet of ice, new roof and upgraded bathrooms.
“We’ve always wanted to keep the facility open and the hope is to put this behind us,” the representative said. “We very much appreciate the public’s support.”

Sad that Belmont Iceland just sits there, with a chain link fence around it. That's the hedge fund business for you.
