It is a shame that John Dillon (“Gun store” in the Feb. 21 edition of the Daily Journal) does not know or understand the laws of our country. Mr. Dillon doesn’t understand what the U.S. Constitution says when it states that one of the main responsibilities of the government is to “Ensure the welfare of the public.” That phrase means that government’s (federal, state or local) task of protecting the public legally outweighs and supercedes any one person or gun store’s claim of rights to open a gun store and make a profit. In this case, the gun store would’ve been located within 1,000 feet of a school.
Mr. Dillon also doesn’t know or understand local city ordinances and permit processes. If the San Carlos city permit process was not 100 percent complete, and a “conditional permit” was issued, which required the gun store owner to await a final vote by the City Council, and the owner of the gun store leased land and made improvements to the land, then that’s the gun store owner’s mistake. It is irrelevant if “this gun store owner was required to take steps other gun stores in the city were not.” San Carlos did not “move the goalpost in the middle of the game.” They have a constitutional right to protect their citizens and school children in their city, especially in light of the recent school shootings in our country. There is insufficient legal grounds for a lawsuit and San Carlos will not lose millions of dollars.
