The Burlingame man arrested on felony drunk driving charges following a fatal multi-car crash Sunday will make his first court appearance this afternoon.
John Barniea, 44, was booked into San Mateo County Jail on suspicion of felony drunk driving following the early morning crash near San Francisco International Airport. He was not arrested in conjunction with the death of 26-year-old Jorge Bandala because the California Highway Patrol determined he was killed in a separate crash.
Bandala, of South San Francisco, died after smashing his motorcycle into a multi-car pileup allegedly caused by Barniea about 2:20 a.m. The original accident was reportedly caused when the 1998 Mazda driven by Barniea went out of control and slammed into a guardrail, rolling back into the roadway, where it was struck by a limousine, which in turn hit a 1999 Audi, according to CHP reports.
Bandala then crashed into the right side of the limousine. Barniea suffered a minor knee injury and was arrested on suspicion of driving under the influence by CHP officers at the scene. His blood alcohol content was not released.
The CHP reported that Barniea is not liable for Bandala's death because he died in a crash separate than the initial pile-up, according to the CHP. However, Chief Deputy District Attorney Steve Wagstaffe said vehicular manslaughter charges could always be added.
