The jury trial for a man alleged to have fatally stabbed his girlfriend in her San Mateo home in 2015 is underway after Judge Lisa Novak was assigned to his trial Tuesday, according to the San Mateo County District Attorney’s Office.
The trial for Anthony Kirincic, 24, could last up to six weeks and will involve two phases, one in which a jury will review whether he is guilty for the November 2015 stabbing and murder of his girlfriend, and another to determine whether he is not guilty by reason of insanity of the crimes he is charged, said District Attorney Steve Wagstaffe.
Kirincic was out of jail for just a few days after completing a four-month sentence for felony domestic violence when he went to the San Mateo home of his girlfriend, Colleen Straw, and allegedly killed her Nov. 28, 2015, according to prosecutors.
Kirincic fled the scene before police arrived, prompting an extensive two-day search before he was finally spotted at his parents’ Redwood City home, according to police and prosecutors.
Though Kirincic made a motion for a new court-appointed lawyer Tuesday, a judge denied it, so defense attorney Savas Loukedis will continue to represent him. The attorney previously questioned his competency in the fall, but criminal proceedings were reinstated after doctors found him competent to stand trial in December, according to prosecutors.
Insanity is a person’s mental state at the time of a crime while competency is a defendant’s ability to aid in their own defense.
He remains in custody without bail, according to prosecutors.
