I have thought about both sides of this issue, and believe the San Mateo City Council should delay a mayor appointment until the fifth member is seated.
This will allow the entire council to participate in all decisions, rather than allow disproportionate actions before the required fifth seat can be included.
The City Council charter clearly mandates a five-member board. There is no emergency, the city attorney has confirmed the charter allows the council to make adjustments as needed regarding a decision on the mayor.
Waiting a short time for the new board member is a reasonable decision. There is a reason our City Council is chartered as a board of five — to avoid the exact situation it is facing now.
Thanks for your letter to the Editor today. You indicated that the City Charter should be followed in the Mayoral selection and I agree. If the charter is not followed I believe it would not be the first time.
If memory serves me correct, and I won't bet my house on it, the city did not follow the charter back in the eighties when they added Martin Luther King day as a holiday. At the time the charter indicated that the city would enact any day designated as a holiday by the Federal Government. During negotiations with the city and the workers union the city declined to make it a holiday and instead wanted and succeeded in trading and an existing holiday on the city calendar, Columbus Day, for MLK day rather than follow the charter and make it a holiday.
