Alvarez, 23, was indicted by a grand jury on Aug. 25 for allegedly gunning down 38-year-old May around 4:30 p.m. on Jan. 7 near Weeks Street and University Avenue. May was responding to a report of a fight, and the shooting occurred as he went to confront a man involved, believed to be Alvarez, according to police.
Alvarez allegedly fled after the shooting. He was arrested the next morning after officers found him suffering from a gunshot wound in the leg, in the back of a car they pulled over near the crime scene. Alvarez has pleaded not guilty to murder and gun possession charges and denied special circumstances allegations of killing a police officer in the line of duty. If convicted, Alvarez faces the death penalty or life in prison without the possibility of parole.
Alvarez has a prior conviction for felony gun possession. He remains in custody without bail.
