Scott Peterson's attorney, Mark Geragos, filed papers Friday declaring he is ready for trial.
Geragos received a one-week continuance on Monday from Judge Alfred Delucchi because he was defending another client in a murder trial in Pasadena. However, an appellate court ruling has delayed that trial.
"Mr. Peterson's counsel, Mark J. Geragos, is not currently engaged in trial before any court and is prepared to proceed to trial immediately," Geragos' declaration said.
Peterson, 31, is facing a possible death penalty in connection with the December 2002 death of his eight months pregnant wife Laci. He is currently in custody in San Mateo County Jail. The trial was moved from Peterson's home of Modesto to Redwood City because of extensive pretrial publicity.
Peterson is scheduled to return to court on Feb. 9.
