A judge dismissed all charges against one of the two men charged with attempted murder for the alleged shooting of a man in the Moonridge area of Half Moon Bay, San Mateo County District Attorney Steve Wagstaffe said.
Orlando Montelongochavarin, 18, who the DA’s Office alleges shot the victim, is still charged with attempted murder, however, a variety of other charges against him, including gang-related felonies, have been dismissed, Wagstaffe said. Montelongochavarin previously pleaded not guilty to attempted murder.
John Neves, 19, was charged with a similar set of charges as Montelongochavarin for aiding and abetting the crime, including attempted murder, but the entirety of those charges have been dismissed, Wagstaffe said.
Montelongochavarin allegedly fired several shots at the victim, who was seated in a car, and then fled the scene along with a 14-year-old friend, believing him to be fatally shot, the DA’s Office said previously. Montelongochavarin had allegedly asked the underage friend to shoot the victim and he refused, and a loaded firearm was found at the friend’s house, according to the DA’s Office.
