A South San Francisco man who allegedly stole an $1,100 necklace he arranged to purchase through a mobile application Wednesday is facing six years in state prison on charges of robbery and assault with a deadly weapon, according to the San Mateo County District Attorney’s Office.
Marc Diosomito, 19, and the 20-year-old man from whom he stole the necklace had allegedly met several times through the application OfferUp to buy and sell items before they arranged a meeting at the parking lot of Burlingame’s New Life Community Church at 1430 Palm Drive before 6 p.m. Wednesday, according to prosecutors.
They allegedly got into the backseat of the victim’s car and Diosomito showed the man he brought the cash with him but said he wanted to try on the necklace first before completing the sale. The victim gave him the necklace and, once he had it on, Diosomito got out of the car and ran to his own vehicle around the corner, according to prosecutors.
The victim allegedly chased after Diosomito and stood in front of his car in an effort to stop him, but Diosomito drove into him, hitting his hip and knee. The victim grabbed onto the passenger’s side window of Diosomito’s car and was dragged a short distance down the road, letting go when Diosomito made a sharp right turn, according to prosecutors.
The victim, who received a major cut on his knee but did not break any bones, gave police Diosomito’s phone number so they were able to find him at his home. The necklace was never recovered, and two witnesses who were at the scene Wednesday allegedly positively identified him, according to prosecutors.
Diosomito pleaded not guilty to his charges when he appeared in court Friday and the county’s private defender program was appointed to his case. He is still in custody on $100,000 bail and will next appear in court Aug. 7 for preliminary hearing, according to prosecutors.
