Two days after a gag order was lifted against triple-murder defendant Eddie Rapoza, the 37-year-old man said he is happy but had no doubts he would be allowed to speak.
The decision to erase the order was purely a technicality for Rapoza, because the Foster City man refused to abide by it. Touting his First Amendment right to free speech, Rapoza said he was always certain Judge Carl Holm would agree.
At San Mateo County Jail, Rapoza continued to fly in the face of his attorney's advice not to try his case in the media, believing it is his only chance at a fair trial.
Rapoza admits he worries anything he says could be used against him by prosecutor Al Giannini. Chief Deputy District Attorney Wagstaffe declined to comment about his office's motives in seeking to lift the gag order against Rapoza.
