San Carlos City Attorney Bob Lanzone sent a memo to the City Council last week outlining residency requirements for holding office. The memo comes on the heels of an article published in the Daily Journal regarding the residency of Council-man Matt Grocott.

"If, during his term of office, he moves his place of residence outside of the city limits or ceases to be an elector of the city, his office shall immediately become vacant," according to state law. However, defining residency becomes complicated. Most decisions about the residency of an elected official comes from the state Attorney General's Office, which has the power to litigate or allow a third party to initiate litigation against a person believed to be out of compliance with state law, according to the memo.
