A 21-year-old San Francisco resident pleaded no contest to two counts of felony assault, one for stabbing a victim outside of San Bruno bar Newell’s in October 2023 and another for assaulting a man while incarcerated for the original assault, San Mateo County District Attorney Steve Wagstaffe said.
The man, Francis Morato, was outside Newell’s when he and 19-year-old Marvin Dismuke were asked by the victim to stop shooting patrons outside Newell’s Bar with an Orbeez gel gun.
In response, Dismuke stabbed the man around 20 times — a crime for which he received five years in prison — and Morato was alleged to have kicked and punched the victim while he was laying in the fetal position.
Earlier in October, Morato went to jury trial for that assault, but after a deadlocked jury, a mistrial was declared and a plea deal was offered.
Wagstaffe did not have immediate information on how much time Morato will now serve, but the plea deal encompassed both charges for the original assault and a later assault that occurred at Maple Street Correctional Facility on Nov. 14, 2024.
Morato will be formally sentenced Dec. 3.
