I can’t believe that the family of Mr. Haung who was not paying attention to the road is thinking of suing Tesla over their Autopilot ( “Tesla fatal crash victim’s family look at legal options” in the April 12 edition of the Daily Journal). When did common sense and responsibility for driving become the responsibility of the car makers?

There is another side to this and is all about our most litigious society forces or affects topic

Early career in people movers (mainly ski lift controls) had our firm leave that industry because of the silly to us…lawsuits by folks injured because of ‘their own’ decisions. Courts and juries allowed huge awards against the equipment providers. Even enforcing ‘new’ safety laws on old product…that was up to code when they were installed

Trust is a key component of our society. Trust that the OEM has taken into account most all possible scenario’s of usage…provided all warnings, etc, etc

The courts know that those warnings (manual, signage, labels, buzzers, etc) are NOT typically read by the user…but…protect the OEMs up to a level if they met or exceeded the required warnings in manuals, signage, labels, etc

Having said that, am on the side of the user in this case. There are too many design issues and this should NOT have been allowed to move into a Beta Test level (outsiders or representative user testing). It is still a laboratory level product, not ready for public testing
