A 61-year-old rapist who previously took a plea deal in a cold case rape case has been deemed eligible for parole, San Mateo County District Attorney Steve Wagstaffe said.
Charles Henry Bracey pleaded no contest to the rape of a San Carlos woman that occurred in 1996 and received 15 years to life in prison in 2005, while he was already serving 28 years to life in prison for a separate crime in Santa Clara County.
Investigators connected him to the San Carlos crime through a state “cold hit” program using DNA evidence and went to jury trial. Bracey subsequently chose to take a plea deal halfway through that trial.
He has been eligible for parole since 2022 under a new state law that allows for individuals convicted of sex crimes over the age of 50 to begin receiving parole hearings after serving 20 years in prison, Wagstaffe said.
“It’s very disgusting to us,” he said. “We feel it’s truly lacking justice.”
The recommendation of the parole board will go through a period of administrative review and needs to be approved by the governor before Bracey could be released, Wagstaffe said.
