Marvin Sullivan, a man accused of killing Millbrae police officer Dave Chetcuti three years ago during a traffic stop, will appear in San Mateo County Superior Court this morning.
Sullivan, 46, was officially ruled competent to face trial in San Mateo County Superior Court on Monday morning. He is expected to appear again today to determine whether his attorneys will contest the ruling and to set dates for future appearances.
Sullivan, a former truck driver, has been committed to a mental facility since he was declared not competent to stand trial in June of 1999.
Doctors examining him at that time found him to be suffering from paranoid schizophrenia with a delusional disorder.
Sullivan allegedly shot and killed Chetcuti on April 25, 1998, during a traffic stop on U.S. Highway 101 near Millbrae. Chetcuti was reportedly coming to the aid of San Bruno police officer who had pulled Sullivan over for having an expired registration sticker. Sullivan, who police say was found to be wearing several pipe bombs on his body and carrying firearms when he was pulled over, allegedly opened fire on that officer with a homemade assault rifle.
When arrested four years ago in an unrelated San Carlos incident, he reportedly told police he was an astronaut and had worked as a secret agent for the KGB.
Sullivan has been confined to mental hospitals and found incompetent to face trial twice before, on charges including shoplifting and making terrorist threats. However, neither of those cases were taken to trial even after he was found competent again, according to defense attorney Vincent O'Malley.
Sullivan is being held without bail at the San Mateo County Jail in Redwood City.<
