Negotiations are under way to settle a civil rights lawsuit brought on behalf of the children of a well-armed robber killed in a 1997 gun battle with police, an attorney for one of the officers said Friday. The February 28, 1997 battle pitting two outgunned police officers against two robbers wearing body armor and spraying the area with automatic weapons fire lasted for nearly an hour outside a San Fernando Valley branch of the Brank of America.  Eleven officers and six bystanders were wounded before police finally killed Emil Matasareanu, 30, and Larry E. Phillips Jr., 26. Matasareau’s family sued Futrell, retired LAPD Det. James Vojtecky and the city in federal court for unspecified damages for Matasareanu’s children, Emil Jr., 8, and Alexander, 4.
