The Daily Journal’s July 2, 2024, article “Supreme Court rules ...” brings up the issue of “immunity” and what it might mean to the country.
Immunity is not an issue reserved for the presidency. Here, the San Mateo County Board of Supervisors has granted itself “governmental immunity” from the California Constitution. At a town hall meeting, when Millbrae residents asked why they would get no voice or vote on the county’s planned La Quinta supportive housing project, former San Mateo deputy police chief, now county executive, Mike Callagy replied: “governmental immunities allow the county to do certain things throughout the county.” He said there would be no referendum vote for Millbrae citizens, or even the Millbrae City Council (Town hall Aug. 12, 2023). This struck residents as undemocratic and wrong, and we soon found out it is indeed a violation of our state constitutional right per Article 34.
The county supervisors’ actions have aligned with the county executive’s assertion of “governmental immunity.” No citizens in San Mateo County have gotten to vote on the county’s low-income public housing projects. Not one supervisor has stood up for Article 34 or attempted to follow that law. For shame.
No individual or government is above the law.

According to the courts, San Mateo County and the State of California are complying with the law, following the law, obeying the law, and implementing the law. It is the City of Millbrae that is willing to waste hundreds of thousands of tax payer money on frivolous lawsuits and recalls just to prevent senior citizens and families from having permanent affordable homes. How many millions of dollars of public money are you going to waste?
