A Foster City firefighter faces up to six months in jail if convicted on charges that he wrongfully evicted a tenant from his San Francisco apartment building to quadruple the rent.
Dan Strambi, 33, evicted longtime Marina District tenant Sandra Meadows in 1999 under the guise of offering her one-bedroom apartment to his sister but instead rented out the unit to another person, prosecutors said. Evicting a longtime tenant to raise the rent is illegal under California's Ellis Act.
The law allows property owners to take their apartments off the rental market for occupancy by either themselves or a family member. If landlords return apartments to rental units within the following three years, they are then prevented from re-renting the units at a rent higher than what the evicted tenants were paying.
Meadows had been paying $650 per month, but the apartment went for $2,700 when it was rented again. The San Francisco District Attorney's office claims that Strambi has garnered $25,000 in extra rent since the new tenant moved in March 2001.
Strambi pleaded not guilty to the charges yesterday morning in San Francisco Superior Court.
