A judge ruled in favor of Covad Communications Inc. on Thursday in a case brought against the company by an Internet service provider cut off from Covad's high-speed connection last week.
Santa Clara-based Covad, which sells digital subscriber lines to Internet service providers, unplugged two providers last week for failing to pay millions of dollars in bills.
The move left thousands of customers nationwide without DSL access. One of the service providers, San Francisco-based DSLnetworks, claims that Covad has been calling, faxing and e-mailing many customers and asking them to sign up for DSL service directly with Covad.
DSLnetworks claims that violates confidentiality clauses in the customers' service agreements and sought an injunction against Covad. Covad spokeswoman Martha Sessums said the confidentiality restrictions weren't included in DSLnetworks' most recent contracts.
Santa Clara County Superior Court Judge William Elfving sided with Covad and denied the injunction request, leaving DSLnetworks to consider its next step.
"The case isn't closed, as far as we're concerned," said Dan Melmed, DSLnetworks' director of marketing.<
