A 27-year-old man who pleaded no contest to felony assault with a firearm for his actions in a 2015 encounter with South San Francisco police was sentenced to 10 years, eight months in state prison Tuesday, according to the San Mateo County District Attorney’s Office.
The sentencing for Ivan Dejesus Gomez came more than seven months after a mistrial was declared following a 26-day trial in which jurors remained deadlocked on the charges of attempted murder and felony assault on a police officer in May. Gomez received 1,665 days credit for time served, according to prosecutors.
Gomez was firing shots in the air when police responded to First Lane around 3 a.m. on New Year’s Day in 2015. Officers couldn’t find Gomez at first as he hid in the shadows, but they found his car. While inputting his license plate in their system, an officer saw Gomez watching through the windows of a parked car, prosecutors said previously.
When an officer ordered Gomez to put his hands up, he allegedly drew a weapon and advanced toward police while firing a shot. An officer retreated to his vehicle and fired at Gomez, who fled the scene but was eventually arrested, prosecutors said. Neither Gomez nor the officer were struck by the gunfire.

District Attorney Steve Wagstaffe said jurors struggled with determining whether Gomez attempted to shoot at the officer or if he was firing up in the air. Though the jury deadlocked on the attempted murder and felony assault on a police officer charges, it convicted Gomez of being a felon in possession of a firearm May 1, according to prosecutors.
Though Wagstaffe acknowledged the outcome was not what prosecutors were expecting, he noted Gomez’s sentence does take a significant portion of his time.
“We always want harsh sentences for people who shoot at our officers,” he said.
Gomez’s defense attorney Peter Arian was not immediately available to comment on the case.
