A Daly City woman accused of molesting her 7-year-old son reached a plea agreement Wednesday just before the case was scheduled to go before a jury.
Nenita Galas Dioso, 42, was charged with 10 counts of lewd acts upon a child under 14 for allegedly kissing the boy's genitals on multiple occasions and making the boy kiss her breasts. The boy's father, who currently has custody of the child, reported the alleged events to police.
Prosecutor Greg Devitt agreed to allow Dioso to plead to misdemeanor child endangerment just as the trial was set to start..
Dioso's defense claimed she had no sexual intent in the touching and was performing a cultural ritual, from a small island in the Philippine chain, of washing the child's genitals by mouth.
"There appeared to be enough ambiguity about whether this was a cultural item that the plea bargain seemed appropriate,'' Chief Deputy District Attorney Steve Wagstaffe said Wednesday.
She will get four years probation.
