The former Redwood City church club treasurer who stole more than $19,000 will spend four months in county jail and must repay the full amount.
Robert Charles Borque, 45, pleaded no contest to felony embezzlement Aug. 18 in return for no state prison and no more than six months in county jail. However, he disputed prosecution claims he took $19,323 between Sept. 1, 2002 and March 11, 2003. Instead, Borque claimed he actually took just shy of $10,000 during his tenure as treasurer of St. Pius Catholic Church Men's Club.
Prosecutors believe he took money from a fund-raising golf tournament and Christmas tree sales and wrote two checks to himself because his pet food business was failing.
The amount in question was important not only to determine a possible sentence but also because Borque undoubtedly would be ordered to give it back.
Sentencing was delayed until Friday so attorneys on both sides could research the amount further. After a restitution hearing Friday morning, Judge James Ellis ordered Borque to serve 120 days in jail with credit for one day already served. He must also reimburse the church and spend three years on probation following his incarceration. All other standard restitution fees and fines were waived.
Borque is free from custody on a $10,000 bail bond. He must report to the jail Jan. 15 to begin serving his term.
