Problem at the Paragon
It was a case of suspicious circumstances at the Paragon in Burlingame on Sunday when the suspect, Daniel Ferlizza, sat at the opposite end of the bar where his former lover was sitting.
Ferlizza bought the victim a "Sex on the Beach" alcoholic drink, according to Officer Dale Wild's police report. The bartender told the victim the drink was from Ferlizza, which prompted her to become angry and walk over to Ferlizza and ask him to leave -- which he would not do. The victim then phoned police.
Officer Wild entered the bar, found Ferlizza and asked him to step outside so Wild could speak to him. According to the police report, the victim told police she had a restraining order against Ferlizza, which stated Ferlizza was not to harass, call, or come within 100 yards of the victim.
Ferlizza said he thought it would be "O.K." as long as he was at the back of the bar, and "It was stupid to say, 'I should have left.'" He then stated he was still in love with the victim -- the reason he purchased the drink for her.
Wild then explained to Ferlizza that he could be arrested for violating the restraining order, to which Ferlizza responded by saying he did not want to be arrested, and subsequently left the scene.
Officer Wild then contacted the San Mateo Police Department where the victim said she had filed the restraining order, but S.M.P.D. said they had no restraining order on file. Wild then returned to the Paragon where the victim told him she had the paperwork for the restraining order -- she did not make it to her court date because she did not want to see Ferlizza in the courtroom.
Wild told the victim she needs to make her court date so her restraining order would be in the system and active. The victim said she'd take care of it this week.

Police were dispatched to the scene of a hit-and-run collision, where they were advised by a citizen that the suspect vehicle was in Millbrae. Police then located the suspect vehicle with the driver leaning against its side, swaying, with dilated pupils, bloodshot and watery eyes, and flushed facial pallor. The police report describes the suspect's attitude as polite. After being asked by police if he had been drinking the suspect replied, "Yeah."
Police identified the man as Duff Mahoney, and gave him a sobriety test. Mahoney failed the standing modified test -- he lost his balance and stumbled right, then swayed back and forth, then side-to-side approximately four inches according to the police report. Vega was also required to perform the heel-toe test, which he failed after he turned around and stumbled to the right.
Vega also failed the breathalyzer test with a .22/.23-percent blood-alcohol level. He was placed under arrest and brought to the Burlingame Police Department.
