September 13, 2006 People vs. Edith Delgado
Historical background,
Judge Thomas McGinn Smith raised Edith Delgado's bail from $300,000 to $3,000,000.00 with no explanation.
Judge Robert Foiles refused to reduce the $3,000,000.00 bail.
Appellate Court ordered:
“We see nothing in the record that justifies $3 million bail ... to secure the public's safety and petitioner's appearance at future court dates.”
“The court ordered a trial judge (Hon Judge Robert Foiles) to set bail "in an amount that does not exceed the amount reasonably necessary to ensure public safety and petitioner's appearance at trial."
Note: The three Judges on the Appellate Court seem to think like most of the residents in San Mateo County.

Edith Delgado is NOT A THREAT TO PUBLIC SAFETY
She is a child who caused a tragic accident. Driver’s license issued 4 months prior to accident.
Prosecutor Aaron Fitzgerald, has now promised us the citizens of San Mateo County that he will prove that Edith Delgado was traveling at a speed of 110 MPH. That’s 10 MPH more than his trail brief reportedly stated. That is a 10% increase. What if it turns out to be 10% lower than the 80 MPH reported that would equal 70 MPH.
Aaron Fitzgerald has also promised us the citizens of San Mateo County that he will prove Edith Delgado was racing another vehicle, I hope he does because so far, that alleged vehicle has not been located or identified. Nor has any other driver.
Aaron Fitzgerald last month brought a case all the way to Jury Trial only to dismiss it, based on error. A check list would have prevented that.
He might be wrong in this case too.
Edith Delgado deserves REASONABE BAIL.

You appear to be such a misguided individual.
You state:

If, as you say, a person who drives a car at about 100 MPH and slams into another car killing 3 people is not a threat to public safety; then what, in your opinion constitutes a threat to public safety?
Also, this individual is NOT a child; this person is an adult. FYI; in the State of California, an 18 year old is an adult.
Finally, anyone who has only had a license for, as you say, 4 months, and who drives a car at about 100 MPH and slams into another car killing 3 people is a serious threat to everyone on the road.

What was the proven speed at time on impact? We don't know.
If a person was driving along the highway at speeds of 65-100.
If it was 90-100mph then I agree with you.
If it was anywhere near 65-80 MPH at time of impact, Thats a different story.
DDA Aaron Fitzpatrick to Judge Robert Foiles stated it was 110 MPH. I hope he can prove that.

Then why did they drop the bail to $1,000,000 instead of $0.00? Oh, I know, a conspirarcy....that's it. Started with DA Fox.
Plain fact is, threat or not, this bastard child needs to stay in the slammer and atone for the killings of these people. There comes a point when the crime is so heinous that this is necessary.
You stogner have no feeling for other's lives only your stupid vendetta against the DA's office. Does this vendetta really make up for your many short comings and lack of social acceptance?
And about this creep in prison. Have you noticed her sorrow only extends to her own freedom? She caused the death of three wonderful people. One would think she would be ready to accept responsibility and pay for her crime. But all she is worried about is her freedom.

I did not mean to take the car out of the incident. I am very clear that was the weapon/vehicle.
I meant take it out of the bail reduction, in other words make it where she could not drive another car, than is she a danger to the public. I say no.

Also it (Henderson case) was a Hit and Run case/with possession of cocaine.....
Edith Delgado case no drugs/alcohol or hit and run.

I was talking about her bail being raised to $3,000,000 by Judge Smith without anyone asking him to raise it from the $300,000.00 amount.

Michael, I think you conviently forget that THREE PEOPLE WERE KILLED in this accident. This bail issue is a non-issue at this point. Edith comes up for a trial. Let a jury hear this one out. I bet you there will be polenty of witnesses from the deceased side there to make sure some justice takes place.
Comparing this event to another accident where no one was killed is not very honest.

I have not forgoten that 3 people died in the Edith Delgado case.
Also in the Henderson case. Rebecca Siebenmorgen was killed.
That is the case I'm comparing it to.
Mark Eugene Henderson, of San Jose, was originally charged with vehicular manslaughter with gross negligence along with drug possession, driving while intoxicated and hit-and-run in the death of Rebecca Siebenmorgen.
