Thank You Daily Journal, It is a little known fact, that the DJ filed a motion to remove a GAG order that was issued against Eddie Rapoza. The GAG order was requested by Jeff Boyarski, Eddie's own attorney. It is rare that a defense attorney would request a gag order against his own client. Was Boyarski afraid that his client would confess to triple murder again? Not likely, Eddie Rapoza never signed a confession, the first voice confession was that of Detective Joe Farmer 10/09/02 8:33 PM. Thats right we have a San Mateo County Sheriff Detective confessing for Eddie Rapoza,
Michelle Durand (reporter for the DJ) has stated that fact (Joe Farmer voice) on public TV.
Jeff Boyarski didn't find that fact unsual, That is one of the many reasons Eddie Rapoza wanted a different attorney to represent his interest.
The Journal believed a sweeping gag order was the wrong way to go and deceided to fight it in court. They won the gag order was lifted.

Michael Thomas Zerbe of Moss Beach is a Hero in my opinion.

Around 9:00 am
Michael Zerbe saw a van tumble off a 200 foot cliff in front of him as he was drinking coffee on the porch. He was traumatized by what he saw, he yelled to Susan S. to call 911 and without thinking about his own personal saftey, he jumped, slid, and fell down the 200 foot clif to the rocks below. Once at the bottom he ran out into the ocean and pulled the man who was floating, to the beach. The man he saved was Eddie Rapoza.
Michael Thomas Zerbe was the only eye Witness to the crash. He was the first person in the ocean 3 minutes after crash.
We the people of San Mateo County did not hear to much about him.

Your memory is selectivley correct!
It is true that the San Mateo County Sheriff Department arrested him while he was sitting in a courtroom for over two hours. You will recall that Michael Zerbe's case had dissapeared from the Computer in San Mateo County for almost 4 hours.
It seems the Sheriff's Department was upset that Mr. Zerbe after he filed a letter with the Board of Supervisors of San Mateo County on October 26, 2005. Requesting an FBI investigation into the witholding/hiding key evidence in the Eddie Rapoza Triple Murder case. Speciffically the six pack sized cooler made of blue nylon material with a strap attactched.
Not only was Michael Zerbe the ONLY eye witness to the crash, he was the only witness to testify(PRETRIAL) that he untangled this strap and cooler from Eddie Rapoza's foot, after he pulled him to the beach.
I'm sure you haven't forgotten, that the Private Defender Program defense attorney Jeff Boyarsky, decided that the Jury didn't need to hear from Michael Zerbe, what could he possibly offer. 1st person on the scene, 1st person to save Eddie Rapoza, 1st person to remove strap fron Eddie's foot
all within 10 minutes of the crash.
I say Michael Zerbe was a Hero on October 6, 2002 and also on October 26, 2005 for his letter.

It is obvious that you are not impressed as much as I am that a person would risk his life to save a stranger. Than risk his well being by filing a letter with the Board of Supervisors (10/26/05) demanding an FBI investigation of the District Attorney's office and the Sheriff's Department, witholding key evidence in a Triple Murder case........the cooler
You will recall I posted on April 17, 2006.
You had asked for me to explain how the jury and court officials were present but Zerbe wasn't.
My response was. "Its simple the date in the computer got changed." The judge is there everyday anyway, he wouldn't know if if a date were changed or not.
On 4/4/06 three different people not including Michael Zerbe confirmed his case had vanished from the San Mateo County's computer for several hours.
Witness Debbie Falce posted here on 4/16/06 that she took Michael Zerbe to the Court on 4/4/06 " I know we were there on April 4th on the 4th floor checking court dates with the court clerk.
It should also be noted that on 4/4/06 the computer did not show that there was a Failure to Appear on 4/3/06......$25,000 Warrant Issued. There was no information on Michael Zerbe that day for several hours.
I stated:
THIS IS NOT THE FIRST TIME COMPUTER TAMPERING HAS HAPPENED IN SAN MATEO COUNTY.

Please note that this IDIOT cannot answer the most elementary of questions. I simply asked what was Zerbe charged with and was he convicted.
This points out what a complete idiot stogner is. Ask him to pass the salt at the dinner table and he will launch into a disertation about the wrong doing of the DA.:eek:

The following letter was Hand Delivered on October 26, 2005.
Members of the San Mateo County Board of Supervisors
400 County Center
Redwood City, CA 94063
Dear Members of the Board:
I write to you today because I feel very strongly that a great injustice has been done in your county. The facts about this injustice are so reprehensible that I am certain it is very difficult for you to believe. I suspect that is why, even though Michael Stogner has brought this issue to your attentionon several occasions, you have yet to take action. I cannot fathom that you have simply chosen to do nothing when faced with the facts given that you were elected to serve the people of the county of San Mateo.
The injustice I refer to is the case brought against Eddie Rapoza III. As an eye witness to the accident involving Eddie and his family, and the first person on the accident scene I can tell you without a doubt that an independent investigation of the case is of the utmost importance.
I personally witnessed evidence that was retrieved by the investigators and is in the possession of the office of the District Attorney of San Mateo which was never entered into evidence during the trial. When I pulled Mr. Rapoza from the water just after the accident, his foot was entangled in the strap of a cooler made of a nylon material. I removed this from Mr. Rapoza's foot. The cooler was retrived from the scene by investigators and is in the possession of the District Attorney. I testified to these facts in court on March 3, 2005 prior to Mr. Rapoza's jury trial.
During his trial, Mr. Rapoza kept making the statement that the reason he had speed off the cliff was that his foot was stuck. Given that his foot was entangled in the strap of this cooler it would be imperative that his defense attorney enter this item into evidence. His defense attorney never even mentioned the cooler. To make the entire case more suspect, Mr. Rapoza's defense attorney chose not to call me, an eye witness to the accident, the first person on the scene, and the person who pulled Eddie from the water and removed the cooler from his foot. I am the only person who could have testified to these facts yet Mr. Boyarsky, the attorney appointed to Mr. Rapoza did not feel that it was important to inform the jury of any of this information.
The actions of the investigators, District Attorney and Mr. Boyarsky are so questionable that failing to call for an outside investigation of this case would be nothing short of negligent.
For one minute, consider, just consider, the possibility that Mr. Rapoza is innocent. His entire family is dead due to a horrible accident, he himself suffered terrible injuries in the accident, and then he was charged and convicted of intentionally murdering his loved ones with out adequate defense representation. What if Eddie is innocent and you, with with a simple request for an outside investigation, have the power to right this injustice but fail to do so. Could you honestly live with being wrong? Could you explain to your children why you did nothing? Could you explain to God?
In my opinion, the cost to the community if no one calls for an investigation into this, and the many other highly suspicious cases in San Mateo County, is just to great for you to choose not to act immediately. Therfore, I strongly request that you take action immediately to bring in the FBI to review the actions of the judicial system in San Mateo County before one more innocent person becomes victim of this system out of control.

Jack and Patty Trayer
Jack and Patty are also on my Hero list,
1) They are the owners of Trayer Engineering, of South San Francisco
2) They are the parents of 5 children
3) They were Eddie Rapoza’s employer.
They were the only people to attend the Eddie Rapoza Triple Murder trial for his support.
Eddie Rapoza had no family members or friends at his trial. The Trayers were there consistently until Jack Trayer suffered from medical problems, and could not attend.
October 26,2004Jack and Patty Trayer spoke publicly to the Board of Supervisors, of San Mateo County, Expressing there concern for the lack of representation being supplied to Eddie Rapoza. This representation just happened to be paid for by San Mateo County.
Supervisor Mark Church responded to the Trayer’s statements, which was unusual because this was during the public comment time and the Supervisors are not supposed to comment. Mark Church recommended the Trayers hire Eddie Rapoza a private defense attorney to replace Jeff Boyarsky.
He then added. “I think he needs an Attorney.” That was an understatement, and the obvious, that is why the Trayers were there. Eddie Rapoza tried to fire his San Mateo County paid attorney twice. The judge denied that motion. He was forced to keep his attorney Jeff Boyarsky.
Patty Trayer: “The problem is when the DA doesn’t report to anybody.” “Eddie’s incarceration “an embarrassment” and claimed it will come back to haunt San Mateo County.”?
The Trayer’s met with Defense Attorneys Chuck Smith and Michael DeVoy, to see if they could afford to hire a private attorneys. The estimated $250,000.00 for an adequate defense was just too much for them to commit to.
Judge Carl Holm in one of his final statements in court called the Trayers CLUELESS.
He didn’t mention them by name of course, but since they were Eddie Rapoza’s only supporters they got his message.
This is the same Judge that I saw give hand signals to prosecutor Al Giannini to stop a certain line of questioning. When that didn’t work he resorted a little screeching sound that would not show up on the transcripts. He also allowed SMC employee Sheriff Detective Gary Ramos aka. Sobe Soda Bottle Guy, to hand out the Jury Questionaires to the fist 40 or so potential jurors, After this behavior was brought to the courts attention he stopped doing that, but the 40 or so jurors were not excused or dismissed because of that conduct.

I have delivered the following letter dated March 30, 2005 to
James P. Fox, Our District Attorney, with cc:San Mateo County Board of Supervisors, County Manager, John Maltbie, and County Counsel Thomas Casey
RE: Deputy DA Al Giannini willfully and knowingly making false statements, mistating testimony and yesterday misstating law in the Eddie Rapoza case.
Dear Mr. Fox,
I am all for getting the bad guy in our county, but I am also in favor of a level playing field. Throughout the Eddie Rapoza case your office through Al Giannini has mislead the court and the jury. Yesterday specifically Al Giannini during cross examination od Dr. Schmidt misstated testimony of his eye witness at the scene of the auto accident. He stated that the witness saw the van traveling down Bernal Ave at a high rate of speed. He knows his witness Ms. Soloway has testified that she never saw the van until it was west of her neighbors house, which would equal about 150 ft in her sight, also from her angle she testified she couldn't see the brake lights. She could only see the side of one of them. Your office through Mr. Giannini states, "She never saw the brake lights go on." That is manipulation of the testimony.
Yesterday Mr. Al Giannini submitted a brief that misstated the law. Hon. Judge Carl Holm brought that to his attention.
Please remind Mr. Al Giannini of his oath, and correct this conduct immediately.

Specifically,fabricating evidence,(In word form only) Sobe Soda Softdrink Bottle.
I say word form only because, this Sobe Bottle, was never entered into evidence.
There was no Sobe Bottle.

Dear Not So, Are you suggesting that something posted on the internet forum is less truthfull/honest than a signed police report, or testimony under oath in a triple murder case, Lets take a close look at that.

We San Mateo County had the privlidge of paying all the expenses to have a witness fly over from Hawaii to Perjure herself at the guidence and direction of James P. Fox and Al Giainni and coached by Detective Gary Ramos.
March 7, 2005.....Kathryn Druava,
under oath said everything the prosecution wanted her to say. Under Cross examination by Connie O'Brien, it was determined that she had just lied several times. She was dismissed and never testified before the JURY.......
How much money was spent on that witness?
Fraud and Perjury are Prevelant in San Mateo County Courts.
I expect it from the defendants, I don't expect it from OUR EMPLOYEES.
