View Full Version : AG's Office Needs to Investigate the 1987 Dr.Ayres Police Investigation

It's time for someone outside the cozy little San Mateo community to open an investigation as to why the County called 16 year old Greg Hogue's molestation complaint against Dr. William Ayres in 1987 "unfounded." I recommend that Attorney General Jerry Brown launch this inquiry.

Here's what the AG's office needs to investigate :

1) Why, when a second boy said that Ayres molested him in 1994, did no one do anything ? Why did the police not go back and take a look at the Greg Hogue case ?

2) Also, in 1994,a third boy went to the California Medical Board and told them that Ayres had molested him in 1966. It is customary for the Board to alert police departments on cases like these. So, now there are three complaints and still nothing is done. Why not ? Was it Ayres' tight friendships with many judges that influenced somebody's decision not to investigate these boys' claims ? In particular, was it Ayres' tight friendship with Judge Marta Diaz, who first sent boys to Ayres when she was in the DA's office in the 1980s and 1990s, and when she became a judge continued to send boys to him as late as 2004 ? I would like the AG to investigate whether Diaz knew about the molestation complaints against Ayres when she was a judge ? If so, why did she continue to send boys to him - like lambs to the slaughter ?

3) I recommend that the AG go back and interview all the players involved in the 1987 police investigation into Greg Hogue's case and the second 1994 complaint against Ayres.

They are: Police officer Rick Nielsen. He is retired but still lives in San Mateo. Greg Hogue has on a number of occasions asked the present-day San Mateo police department to speak with Nielsen, but they won't let him. Why not ? Doesn't a victim have a right to find out what happened to his case and why it was wrongly deemed "unfounded ?"

- Also, then-Sgt. Lee Violett was with Nielsen when they confronted Ayres in 198. Violett recently retired as San Bruno police chief. Someone should find out what he remembers.

- After Violett and Nielsen confronted Ayres, who denied everything, Ayres mysteriously sends Greg Hogue's mother a check for $1000, which she and her therapist Jeff Lugerner, who filed the abuse claim to Childrens Services, believed was a bribe to keep the Hogues quiet. At the urging of Lugerner, Greg's mother turns Ayres' check over to Rick Nielsen. But why then, has both that check and Greg's ENTIRE case file gone missing since then ? Did Nielsen return the check to Ayres ? Did he alert the DA ?The AG needs to investigate this.

- The AG also needs to interview Don Phipps, who was the San Mateo police chief in 1987.

- The AG needs to interview Jeff Lugerner, the therapist who filed Greg's abuse claim with Childrens' Services. Lugerner has told the papers that Childrens Services got scared when he filed the complaint because they referred many boys to Ayres and indeed , Ayres was their "primary vendor." Lugerner says that CS did not properly investigate and that there was a cover up. The AG needs to investigate these claims.

- The AG needs to interview Childrens Services social worker Judy Knowlton, whose name is on Greg Hogue's abuse complaint. She just retired but is still in the community.

-The AG needs to interview child psychiatrist Dr. David Schwartz. Officer Rick Nielsen interviewed Dr. Schwartz for the Greg Hogue case and asked him if it was normal for a child psychiatrist to make his boy patients strip and then touch them. Schwartz said "Absolutely not - under no circumstances ! " and then asked Nielsen if he was referring to Ayres. Also Schwartz told Nielsen that he believed he had a male patient who had been molested by Ayres. Schwartz was a highly respected doctor who worked with kids at Hillcrest. In spite of this interview, why did the police deem Greg Hogue's claim "unfounded ? "

-The AG also needs to interview Sgt Wayne Hoss, who investigated the 1994 complaint against Ayres. Hoss still works for the San Mateo PD. Why did the police not investigate further, now that they had a second complaint on Ayres ?

I have no doubt that the San Mateo District Attorney's office was aware of the police investigation into Dr. Ayres in 1987 . What we don't know is who knew about it.
The AG needs to find out:
Who was head of adult sex crimes in 1987 ?
What were the names of prosecutors who worked in adult sex crimes in 1987 ?
Did any of these prosecutors at at any point work in the juvenile division and if so, did any of them refer kids to Ayres ?

- Who was the head of adult sex crimes in 1994 ?
- What were the names of all the prosecutors who worked in adult sex crimes ?
-Did any of these prosecutors at any point work in the juvenile division and if so, did they refer kids to Ayres ?

- Finally - Since 2005, a source from within the San Mateo DA's office has told four different reporters - including one from the Chronicle, that it was a female prosecutor who told the police that she was not going to pursue a case against Ayres even though, this source told the reporter "they had damning evidence against Ayres and that the DA needed to prosecute." The AG needs to find out if this is true and if so, was it because this prosecutor had a tight friendship with Ayres and referred kids to him for years ?

If the police and the DA's office and Childrens Services had done their jobs properly, Ayres would not have gone on to molest boys for the next 20 years and he wouldn't have become President of the American Academy of Child and Adolescent Psychiatry and he wouldn't have received that 2002 lifetime achievement award from the San Mateo Board of Supervisors for his "tireless work to improve the lives of children."

San Mateo deserves answers to these questions NOW.

Hon. Judge Marta Diaz was working for James P. Fox of the District Attorneys Office as a DDA prosecutor in the late 80's.....

Is she the female prosecutor who chose not to persue a case against Dr. William Ayres? Also this sounds like the San Mateo Police Department did formally request prosecution of Dr. William Ayres back then.

For those of you who don't know the Hon. Marta Diaz is the Judge for Hillcrest and has referred boys to Dr. William Ayres.

Ok, this is something I just learned: It may mean nothing, but then again, it could mean something.

Judy Knowlton, the social worker whose name is on Greg Hogue's Childrens Services report in 1987, ( see my posting at the top)told the mother of an Ayres victim in July 2006 who was calling on behalf of Greg to try and get answers, that she didn't remember Greg Hogue or the Ayres case. But a source who knows Knowlton just told me that Knowlton told her recently that she does remember the Greg Hogue case. Why would Knowlton tell the mother of a victim who was just trying to help Greg Hogue one thing and this other source another ? And why wouldn't Knowlton, a social worker who is supposed to be helping kids, help an Ayres victim find answers ? Bear in mind that Jeff Lugerner, the therapist who first filed a complaint to Childrens Services told the Chronicle that they didn't investigate properly and may have in fact covered it up because they were using Ayres..

I am hearing that Juvenile Judge Marta Diaz made her views loud and clear in the courthouse during the 2002 criminal investigation into Ayres that the "police better be careful investigating Ayres" because he was a friend of hers. I know that reporters have heard this story too.

The question is: how did Judge Diaz get wind that the police were investigating Ayres in 2002 ? And here's another question: did she tip off Ayres that the police were investigating him ?

The question is: how did Judge Diaz get wind that the police were investigating Ayres in 2002 ? And here's another question: did she tip off Ayres that the police were investigating him ?

DA Wagstaffe needs to investigate the doctors who covered for Ayres and also Marta Diaz ASAP ! When is everyone going to realiz that the Ayres problem has very very deep roots ? Deeper than anyone could know ?

In his well-written and researched essay for the Annals of Psychotherapy (Spring 2008)called As Hippocrates Forewarned: 'Sexual Misconduct' by Physicians, Dr. Bruce Gross discusses the Ayres case at length.

Excerpt of particular note:

In 1987, a licensed clinical social worker filed a report of suspected child abuse identifying Ayres as the suspect. Apparently a teenage male client disclosed that Ayres had fondled him in 1985, after the patient had been referred to Ayres for treatment by his school. Upon initial investigation and essentially no publicity, the complaint was determined to be “unfounded” and not pursued. Similarly, in 1992, a prisoner at California’s Atascadero State Hospital told an evaluating nurse that Ayres had molested him during a court-ordered therapy session. Although there is evidence of a report having been filed with authorities, there is no indication that an investigation was conducted at that time.

The investigating officer in the second case was Wayne Hoss, who is still with the San Mateo PD. No one from the PD has explained why they did not investigate the good doctor more extensively after a second complaint by a boy. As far as we know, no reporter has ever contacted Hoss to find out.

Why didn't the police investigate further after the second complaint?

Dr. Gross, is on the staff of the psychiatry department Keck School of Medicine at USC Los Angeles and is a renowned forensic psychologist.
Kudos for Dr. Gross for bringing this point to light.
