SAYSO seeks to allow San Carlos residents to practice and play soccer in their own city. Calling the lawsuit 'frivolous and without merit' insults the taxpaying residents of Mr. Weiss' city.

The San Carlos United Soccer Club's worry that it will need to hire a lawyer to protect itself and the privacy of its members is unfounded. The San Carlos United Soccer Club is not a defendant in the lawsuit. Furthermore, the City of San Carlos claims to have already requested and received membership information from the San Carlos United Soccer Club, so this wouldn't be the first time that the San Carlos United Soccer Club has released the information. Unfortunately, the City hasn't found, maintained, or produced the information it claims to have received from the San Carlos United Soccer Club; and only a single person in the City has recollections of having seen the information. By subpoenaing the original information, SAYSO is validating the City's claims that primarily only San Carlos residents in the San Carlos United Soccer Club are using San Carlos soccer fields.

SAYSO has already provided similar information, statistics, and documents to the City in response to the City's demand for documents. And, other parties have been subpoenaed and have provided their organization's information. The issue of privacy has already been considered and addressed by the parties to the lawsuit.

True, San Carlos United Soccer Club contributed to and is a significant beneficiary of the current San Carlos field use policy that keeps SAYSO's San Carlos residents from using the fields in their own city. And, true, SAYSO has noted that the San Carlos Parks and Recreation Department employee who processed SAYSO's past field use applications, and apparently the only person who has recollections of the qualifying information previously received from the San Carlos United Soccer Club, has an apparent conflict of interest due to her long-standing connection with the club. However, the San Carlos United Soccer Club is not a defendent in the current lawsuit, and it doesn't need to spend a dime to hire a lawyer in order to provide the information, statistics, and documents requested ... unless it also wants to keep SAYSO's San Carlos residents from using San Carlos fields, or unless it thinks it is hiding something.
