The unnamed Fire Marshall told us,
"THIS FIRE WAS NOT SET BY HUMAN HANDS."
"But the DA...(meaning James Fox and Steve Wagstaffe) wanted a second opinion and then everybody got busy." Horsley said
Got Busy doing What? I hope he didn't mean got busy like Sheriff Detectives Gary Ramos and Joe Farmer got busy in the Triple Murder case of Eddie Rapoza III...Sobe Soda Softdrink Bottle 10/09/2002 8:30PM

Why wouldn't the unnamed Fire Marshall be the expert as to ARSON.
Who is the Fire Marshall?
It's not good when the Sheriff Department determines the GUILT of someone before a trial. Like the Eddie Rapoza case the same Sheriff determined he was guilty the same day of the crash.
Also why isn't our Sheriff Greg Munks commenting on this case?

Its nice to know that James P. Fox and Steve Wagstaffe are concerned about the San Mateo County Taxpayers of which our County Manager John Maltbie is not.
In the article Steve states that by not going for the death penalty this saves the taxpayers money because the defendant does not have the right to two attorneys paid for by the Private Defender Program.
For those who don't know...We San Mateo County are the only County out of 58 in the State of California who has PRIVATE DEFENDER PROGRAM.
All the other Counties have PUBLIC DEFENDER.
This makes a cozy relationship between the District Attorneys Office, The Sheriff's Office, The Probation Department, and the Private Defender Program.
Basically the are all on the same TEAM. Put on a good show, make it look like the defendant had a defense attorney...etc.
To see this cozy relationship a little better.

look up the Advisory Board and the Board of directors.
I have been informed that they are all there as PRIVATE CITIZENS.

Michael, Don Horsley is no longer the sheriff, just a private citizen like you and I. He is free to express his opinion just like you are. I share Horsley's belief of the arsonist's guilt. We will just have to wait and see and hope that the foresic evidence in this case can prove the guilt.

While true Don Horsley is no longer our Sheriff. He is currently an elected official: Sequoia Hospital Director.
He never made that statement "He is a killer." while he was our Sheriff.
You are welcome to share Horsleys belief of the ALLEDGED arsonist's guilt.
That makes at least two of you.

We both agree that Eddie Rapoza III was convicted in San Mateo County Superior Court. I've never said he was not found GUILTY.
What I have said and continue to say is at least two San Mateo County Employees, SMCSD Gary Ramos and Joe Farmer have committed Felonies in his case. October 9, 2002 Police Report. 8:30 PM Sobe Soda Softdrink Bottle. Filing a false Police report... thats what i have said.
Edith Delgado...I am not saying she is innocent, I said our Judge Smith abused his authority by raising the bail from $300,000 to $3,000,000 without being asked by the DA'S office. The Appellate Court said the same thing.....He Abused his authority.

Charles Edward Schuttloffel case: We have an un-named Fire Marshall who after investigating the scene.."This fire not set by human hands."
I would think this Fire Marshall would know more about fires and who started them than Don Horsley.
I would also think "This fire not set by human hands." would rule out
Charles Edward Schuttloffel, the man now three years later being charged with arson.
I personally would not trust anything Don Horsley said, either as a private citizen, our Sheriff, or Sequoia Hospital Director. I would not trust anything he said including statements made under oath.
I base that on the following.
I personally witnessed him testify under oath on August 2, 2004
Location San Mateo, California
Congressman Chris Shayes, Tom Lantos, etc.
Don Horsley "All 10lbs of C-4 were recovered." he was asked again and answered the same. " All 10lbs of C-4 were recovered.
Just minutes before Don Horsley testified, another gentleman by the name
of Mr. Walfred (Walter) Nelson of the ATF testified "All 34lbs were recovered.
Bill Silverfarb of the San Mateo daily Journal wrote an article 8/3/04
Congressman grills feds....usuing the 10lbs of C-4 number.
I posted to the SMDJ that there was an error in that article. no correction made.
Base on the testimony at the 8/2/04 hearing we have a minium of one official committing perjury. Possibly Both.
Both gentleman stated they had not been to the site prior to the theft and Don Horsley once after. ATF guy never.
This is why I would not trust any statement from Don Horsley.

Dek Ketchum of The Private Defender Program... has sucessfully kept the Grand Jury Transcripts sealed.
I wonder if Charles Rdward Schuttoffel wants them sealed.
The PDP attorney is considering asking for the seal to become permanent. I'll bet he is. The District Attorneys office does not want the public to know what statements were made to the Grand Jury to get an indictment, in a case where there is no motive..no method...and the Fire Marshall concluded this fire was not set by human hands.

At the bottom of todays article it mentions an aside case drugs and resisting arrest in 2006. I wonder if the San Matepo County Sheriff's Department was involved or a different law enforcement branch?
The story here is the Grand Jury Transcripts....being witheld from the public.

DDA Sean Gallagher thinks that making the transcripts public will not affect a fair trial in San Mateo County.
I agree 100% with Sean Gallager lets see the transcripts.
